This requirement is crucial to ensure compliance with stringent certification and logistical processes, thereby guaranteeing adherence to the regulatory framework established by the EU. Contractors may also qualify if they provide a Non-European Central PCS and can provide comprehensive evidence that their systems are equivalent to those manufactured in Europe, meeting or exceeding all relevant European standards and certifications. This evidence must include detailed documentation of compliance with EU technical, safety, and environmental regulations. See point 5.3.3. \n\nTo evidence this requirement compliance (5.1.2) Contractor shall submit a list of references, at least one, detailing: Project Name, Final Client (the name and the contact details), Execution Year (DD.MM.YYYY), Regulatory Body  (the name and the contact details), Manufacturer (the name and the contact details) and evidence confirming that the contracts listed in the list of references have been successfully executed. See the Annex No. 5, point B.  \n\nO&M Services Available in Poland and/or Europe: The Contractor is required to have or ensure a local or regional O&M (Operations & Maintenance) presence confirming 24/7 monitoring.  \n\nTo evidence this requirement compliance (5.1.3) Contractor shall submit a list of references, at least three, detailing: O&M Service Provider (the name and the contact details) , Location of Services, Monitoring Capabilities (24/7) (Yes/No), Basis for Resource Availability and evidence confirming that the contracts listed in the list of references have been successfully executed. This evidence must include detailed financial reports, product quality certifications, and references from projects. See point 5.3.3. \n\nDDP (Incoterm 2023) (Delivered Duty Paid) mandatory: meaning the Contractor bears all transport, customs, taxes, and delivery risks up to the site in Poland. Contractors may propose equivalent delivery terms if they can demonstrate that these terms provide the same level of risk mitigation and cost coverage as DDP. Such proposals must include detailed documentation outlining how all transport, customs, taxes, and delivery risks will be managed and covered, ensuring no additional burden or risk to the client. See point \n\nOnly Contractors who meet the conditions for participation referred to in the Notice shall be admitted to further stages of the procedure. Assessment of the Contractors' fulfillment of the conditions for participation in the procedure shall be made on the basis of documents and statements provided along with the Request for participation. \n\nContractors who do not demonstrate meeting the conditions for participation or do not confirm that there are no grounds for their exclusion, shall be excluded from the procedure and shall not be invited to the next stage of the procedure. \n\nThe assessment of meeting the conditions for participation in the procedure shall be made on the basis of information contained in the required documents and statements, according to the formula: complies / does not comply. \n\nIn the case of Contractors jointly competing for the award of the contract, the requirements specified in section 5  shall be met, if they are met by at least one of the Contractors. \n\nIn the case of the Contractor relying on the resources of other entities in order to meet the conditions for participation in the procedure, a completed and signed Part II and Part III of Annex No. 5 must be submitted. \n\nIf the Contractor fails to submit statements or documents required from the Contractor in this Notice, or other documents necessary to conduct the procedure, the statements or documents are incomplete, contain errors or raise doubts indicated by the Contracting Authority, the Contracting Authority shall call upon the Contractor to submit, supplement or correct them or to provide explanations within the deadline indicated by it, unless, despite submitting, supplementing or correcting them or providing explanations, the Contractor is subject to exclusion or it would be necessary to revoke the conditions or invalidate the procedure. The Contracting Authority may request the Contractor to supplement the statements or documents in the above scope multiple times. Failure to supplement the documents indicated by the Contracting Authority within the prescribed period shall entitle the Contracting Authority to exclude the Contractor from the procedure without further notice. \n\nThe Contracting Authority always allows the possibility for the bidder to apply solutions equivalent to those indicated in the request for proposal. A bidder who decides to present equivalent solutions is obliged to prove that the solution or product they propose meets all the requirements specified in the request for proposal, in terms of the indicated parameters, which must be at a level no worse than those provided in the request for proposal. In cases where the request for proposal and its attachments contain any references to specific products, sources, trademarks, patents, origins, or particular processes characterizing the products or services provided by a specific contractor, it should be assumed that the Contracting Authority has provided such a description with the possibility of submitting equivalent offers.
