The contract will be prepared jointly by the Ordering Party and the Tenderer on the basis of the provisions in this request for proposal. The implementation of this agreement will depend on the Ordering Party being awarded funding in the 1.1 SMART Path, European Funds for the Modern Economy (FENG.01.01-IP.02-002/23) call organized by the Polish Agency for Enterprise Development (PARP).\nb) The Agreement may be terminated at any time with the consent of both Parties. \nc) Termination and withdrawal from the contract must be made in writing to be effective, failing which it shall be null and void.  \nd) The contract expires at the end of the period for which it was concluded or when there are circumstances for which the parties are not responsible and which prevent its further performance.\ne) The conditional agreement will expire if the Ordering Party is not granted the subsidy referred to in point a)\nf) The Ordering Party allows for an amendment to the contract in the form of an annex in the event of: \ni. the Funding Body requires a change to the manner of performance of the contract by the Tenderer\nii. when the deadlines for completion of the stages of the project under which the contract is implemented change, \niii. significant changes in the subject and manner of performance of the Agreement not caused by an act or omission of any of the Parties to the Agreement, \niv. force majeure which makes it impossible to perform the subject matter of the contract in accordance with the tender specifications\nv.
