{"status":"OK","data":{"advertisement":{"id":208652,"title":"Zapytanie ofertowe 17 05 2023 D","partial_offer_allowed":false,"publication_date":"2023-05-19","submission_deadline":"2023-05-24 23:59:59","planned_sign_date":"2023-05-01","supplementary_orders":null,"terms_of_contract_change":"VIII.\tESSENTIAL TERMS OF THE AGREEMENT:\nVIII.1.\tThe selected Bidder will be obliged to conclude a contract on the terms set out in this Inquiry and offer.\nVIII.2.\tIn the event that the selected Bidder withdraws from the contract with the Ordering Party, the Ordering Party may conclude a contract with the next Contractor whose offer will receive the next highest number of points.\nVIII.3.\tThe Ordering Party reserves the right to amend the terms and conditions of the contract concluded as a result of this procedure:\na.\tin the event of a change in applicable regulations, if it is necessary to adapt the content of the Agreement to the current legal status (including applicable standards),\nb.\tin the event that the need to introduce changes results from changes in guidelines, recommendations or decisions issued by the Institution that granted funds to finance the Agreement,\nc.\tin the event of a change in the tax rate on goods for the assortment constituting the subject of the Agreement,\nd.\ttype of assortment - in the event of suspension of production or withdrawal from production of a chemical compound offered by the Bidder, the Ordering Party allows a change to its equivalents with the same or better parameters as the assortment withdrawn (suspended) from production, for a price not higher than the one specified in the offer, provided that the Supplier obtains consent of the Ordering Party, without the need to amend other provisions of the Agreement; When the replacement of the chemical compound with the equivalent is impossible and there is the absence of the availability of the chemical compound offered by the Bidder, it is allowed to change the compound to the another compound from the list of the compounds pre-selected by the Ordering Party 7ZAP_Order_387 with reservation that price for the equivalent compound must be as much as it was set in the original offer; when it is impossible to replace the missing chemical compound with a substitute, it is finally allowed to exclude the chemical compound from the delivery, however the total net price must be proportionally lowered, minimum quantity that must be delivered is 360 compounds; without the need to amend other provisions of the Agreement;\ne.\toccurrence of force majeure - the Ordering Party reserves the right to amend the terms of the contract concluded as a result of these proceedings also in the event of force majeure understood as an event that substantially hinders the performance of obligations under the co-financing contract, which the parties could not foresee and which they could not prevent, and overcome by acting with due diligence.\nVIII.4.\tThe Ordering Party reserves the right to impose contractual penalties on the Supplier in the event of withdrawal by the Ordering Party from the contract due to circumstances for which the Supplier is responsible, as well as in the event of delays in the delivery date for reasons attributable to the Supplier:\na.\tthe Ordering Party withdraws from the contract or terminates it due to circumstances for which the Supplier is responsible, the Ordering Party has the right to charge a contractual penalty in the amount of 10% of the remuneration indicated in the Contract,\nb.\tthe Supplier's delay in the performance of obligations under the contract, the Ordering Party has the right to charge a contractual penalty in the amount of statutory interest on the value of remuneration for each day of delay.\nc.\tThe Contractor shall pay the contractual penalties on time and to the account specified by the Ordering Party.
